These Terms of Service ("Terms") govern your access to and use of the FanWork platform, including our website, mobile applications, and all related services (collectively, the "Service"). The Service is operated by Data Town Inc. ("FanWork," "we," "us," or "our").
By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Service.

1\. Eligibility
1.1 Age Requirements
To use FanWork, you must meet the following age requirements based on your country of residence:

IMPORTANT: If you are under the age of 18 (or the age of majority in your jurisdiction), you must have your parent or legal guardian's perCollab to use the Service. By using FanWork, you represent that you meet these requirements.
1.2 Capacity
You represent and warrant that you have the legal capacity to enter into a binding agreement and are not barred from using the Service under any applicable laws.
1.3 Compliance with Laws
You agree to comply with all applicable local, state, national, and international laws while using the Service.
2\. Account Registration
2.1 Account Creation
To access certain features of the Service, you must create an account. During registration, you will be required to provide:
- Basic Information: Profile image, username, nickname, country, and preferred language
- Social Login: Authentication via supported platforms (Google, Apple, Kakao, etc.)
2.2 Account Security
You are responsible for:
- Maintaining the confidentiality of your account credentials
- All activities that occur under your account
- Immediately notifying us of any unauthorized use or security breach
2.3 Account Information
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
2.4 One Account Per Person
Each individual may maintain only one active account. Creating multiple accounts to circumvent restrictions or for abusive purposes may result in termination of all accounts.
3\. User Tiers and PerCollabs
3.1 Tier Structure
FanWork operates a tiered user system based on the information you provide:

3.2 Tier Upgrades
You may upgrade your tier at any time by providing the required additional information through your account settings.
3.3 Tier Requirements
- Producer Tier requires email verification and at least one published Post before creating Collabs.
- FanWork reserves the right to modify tier requirements with reasonable notice.
4\. Service Description
4.1 Platform Overview
FanWork is a "Crowd Producing" platform that enables fans to:
- Create and share fan content (Posts)
- Organize and participate in collaborative fan projects (Collabs)
- Connect with fellow fans through social features
- Build reputation through the Respect Points system
4.2 Service Availability
We strive to provide continuous access to the Service, but we do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to:
- Scheduled maintenance (with advance notice when possible)
- Emergency repairs
- Technical issues beyond our reasonable control
- Force majeure events
4.3 Service Modifications
We reserve the right to modify, update, or discontinue any aspect of the Service at any time. Material changes will be communicated through the Service or via email.
5\. User Content
5.1 Definition
"User Content" includes all content you submit, post, or transmit through the Service, including but not limited to:
- Posts (text, images, videos)
- Comments and reactions
- Collab descriptions and subCollabs
- Profile information
- Direct messages
5.2 Content Ownership
You retain ownership of your User Content. However, by submitting User Content, you grant FanWork a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to:
- Host, store, and display your User Content
- Reproduce, modify, and distribute your User Content in connection with operating the Service
- Use your User Content for promotional purposes (with the option to opt out)
5.3 Content Responsibilities
You are solely responsible for your User Content and represent that:
- You own or have the necessary rights to post the content
- Your content does not infringe any third-party rights
- Your content complies with these Terms and our Community Guidelines
5.4 Content Removal
We may remove User Content that violates these Terms or our Community Guidelines. We also reserve the right to remove content at our discretion to maintain platform integrity.
5.5 Content Retention After Account Deletion
- Posts, comments, and Collab content you created will remain on the platform after account deletion
- Your username will be changed to "DeletedAccount\_\[number\]"
- Your profile image and personal information will be removed
- See Section 11 for full details on account termination
6\. Collabs
6.1 Collab Types
FanWork offers two types of Collabs:

6.2 Collab Lifecycle
Collabs progress through the following statuses:

6.3 Collab Approval
All Collabs must be submitted for approval before becoming visible to the community. FanWork reserves the right to reject Collabs that:
- Violate Community Guidelines
- Contain inappropriate or harmful content
- Do not meet quality standards
- Raise legal or safety concerns
6.4 Collab Participant Obligations
Collab Providers (creators) agree to:
- Provide accurate Collab descriptions
- Fulfill commitments to participants
- Complete settlement within the specified timeframe
- Not abandon Collabs once participants have joined
Collab Collaborators (participants) agree to:
- Complete assigned tasks as agreed
- Communicate openly with the team
- Respect deadlines and commitments
6.5 Collab Restrictions
- You cannot delete your account while participating as a Provider or Collaborator in an active Collab
- Approved Collabs cannot be edited (except Collaborator information during RECRUITMENT)
- Collabs that remain in RECRUITMENT for an extended period may be subject to extension or cancellation
6.6 Collab Disputes
Disputes between Collab participants should first be resolved directly between parties. FanWork may mediate disputes at our discretion but is not obligated to do so.
7\. Respect Points
7.1 Overview
Respect Points are a non-transferable reputation metric that reflects your engagement and contributions to the FanWork community.
7.2 Earning Respect Points
Points are earned through various activities including:
- Social engagement (likes, comments, reactions)
- Creating content (Posts, SubCollabs)
- Participating in Collabs
- Receiving positive feedback from collaborators
7.3 Point Characteristics
- Respect Points have no monetary value
- Points cannot be purchased, sold, or transferred
- Points are displayed only in your personal activity area
- FanWork may adjust point values or earning methods at any time
7.4 Point Loss
Respect Points may be reduced or reset due to:
- Violations of Community Guidelines
- Account suspension
- Fraudulent activity
8\. Payments and Fees
8.1 Overview
FanWork offers both free and paid features. This section governs all financial transactions on the platform.
8.2 Collab Service Fees
Platform Fee Structure:

- Fees are calculated on the total Collab budget as declared by the Collab Provider
- Fees are deducted automatically before settlement to Collaborators
- Minimum fee may apply regardless of Collab size
- FanWork reserves the right to adjust fee rates with 30 days' notice
8.3 Payment Processing
Supported Payment Methods:
- Credit/Debit Cards (Visa, Mastercard, American Express)
- PayPal
- Local payment methods (varies by country)
- In-app purchase through App Store / Google Play
Payment Processors: We use third-party payment processors (such as Stripe, PayPal) to handle transactions. By making payments, you agree to the payment processor's terms of service.
8.4 Currency and Pricing
- All prices are displayed in the user's local currency where supported
- Currency conversion rates are determined at the time of transaction
- Prices may vary by region due to local economic conditions and regulations
8.5 Billing and Receipts
- You will receive an electronic receipt for all transactions
- Transaction history is available in Settings \> Payment History
- Receipts comply with local invoicing requirements
8.6 Taxes
- Prices may be exclusive or inclusive of applicable taxes depending on your jurisdiction
- You are responsible for any taxes applicable to your transactions
- FanWork will collect and remit taxes where legally required (e.g., VAT in EU)
8.7 Refund Policy
Collab-Related Refunds:

General Refund Terms:
- Refund requests must be submitted within 14 days of the transaction
- Refunds are processed to the original payment method
- Processing time: 5-10 business days
- FanWork reserves the right to deny refunds in cases of fraud or abuse
Digital Content:
- Digital goods and services are generally non-refundable once delivered
- EU/UK users have withdrawal rights as specified in Section 23
8.8 Chargebacks and Disputes
- If you dispute a charge with your bank/card issuer, we may suspend your account pending investigation
- Fraudulent chargebacks may result in permanent account termination
- Contact support@fanwork.world before initiating a chargeback to resolve issues
9\. Creator Monetization(Details will be updated when the service launches)
9.1 Overview
FanWork enables eligible creators to earn money through fan support, tips, and exclusive content. Participation in monetization features is subject to additional eligibility requirements.
9.2 Eligibility for Monetization
To receive payments from fans, you must:
- Be at least 18 years old (or age of majority in your jurisdiction)
- Have a Producer tier account in good standing
- Complete identity verification (KYC)
- Provide valid tax information
- Link a valid payout method (bank account, PayPal, etc.)
9.3 Fan Support (Tipping)
How It Works:
- Fans can send voluntary financial support ("Tips") to creators
- Tips can be one-time or recurring
- Minimum and maximum tip amounts may apply

9.5 Payouts

9.6 Creator Tax Responsibilities
- You are responsible for reporting and paying taxes on your earnings
- FanWork will issue tax forms as required by law (1099 in US, etc.)
- You must provide accurate tax information (W-9, W-8BEN, etc.)
- Failure to provide required tax information may result in payout holds or withholding
9.7 Content Restrictions for Monetized Content
Monetized content must comply with all Community Guidelines plus:
- No adult/sexual content (even with age restrictions)
- No copyrighted material you don't have rights to
- No misleading offers or scams
- No solicitation of offline payments to bypass the platform
9.8 Monetization Termination
FanWork may suspend or terminate your monetization privileges for:
- Violation of Terms or Community Guidelines
- Fraudulent activity
- Excessive chargebacks or disputes
- Failure to maintain eligibility requirements
Upon termination:
- Pending payouts may be held for up to 180 days
- Held funds may be forfeited in cases of fraud
- Recurring supporter subscriptions will be cancelled
10\. Advertising(Details will be updated when the service launches)
10.1 Types of Advertising
FanWork may display the following types of advertising:

All paid advertising and sponsored content will be clearly labeled as:
- "Ad" or "Advertisement"
- "Sponsored"
- "Paid Partnership"
- Or similar clear disclosure
10.3 User-Created Sponsored Content
If you create sponsored content (paid by a brand):
- You must clearly disclose the paid relationship
- Use FanWork's built-in sponsorship disclosure tools
- Comply with FTC guidelines, ASA rules, and local advertising laws
- Ensure the content complies with all Community Guidelines
Disclosure Requirements:
- Disclosure must be clear and prominent
- Use language like "Paid partnership with \[Brand\]" or "\#Ad"
- Disclosure must appear before any "read more" truncation
10.4 Prohibited Advertising Content
The following may not be advertised on FanWork:
- Adult/sexual products or services
- Tobacco, vaping, or recreational drugs
- Weapons or ammunition
- Gambling (unless legally licensed)
- Cryptocurrency (except established platforms with approval)
- Multi-level marketing or pyramid schemes
- Counterfeit goods
- Political advertising (in certain jurisdictions)
10.5 Ad Personalization
- We may use your data to show relevant ads as described in our Privacy Policy
- You can manage ad personalization in Settings \> Privacy \> Ad Preferences
- Opting out of personalized ads will not reduce ad quantity, only relevance
10.6 Ad Revenue Sharing
Eligible creators may participate in ad revenue sharing programs:
- Eligibility requirements apply (follower count, engagement, etc.)
- Revenue share percentage: \[X\]% to creator
- Subject to separate Creator Program terms
10.7 Brand Safety
FanWork maintains brand safety standards:
- Ads will not appear alongside prohibited content
- Advertisers can exclude certain content categories
- Content that violates guidelines will be demonetized
11\. Marketplace(Details will be updated when the service launches)
11.1 Overview
FanWork Marketplace enables users to buy and sell fan merchandise, digital goods, and services. Marketplace participation is subject to additional terms.
11.2 Seller Eligibility
To sell on the Marketplace, you must:
- Be at least 18 years old
- Have a Producer tier account in good standing
- Complete seller verification
- Agree to Marketplace Seller Terms
- Comply with all applicable laws for selling goods/services
11.3 Permitted Items
Allowed:
- Original fan art and merchandise
- Fan-made crafts and goods
- Digital art and designs
- ComCollabs for custom work
- Services (art comCollabs, translations, etc.)
Prohibited:
- Official merchandise (unless authorized reseller)
- Counterfeit goods
- Items infringing intellectual property rights
- Prohibited items under Community Guidelines
- Items illegal in buyer's or seller's jurisdiction
11.4 Listing Requirements
Sellers must:
- Provide accurate product descriptions and images
- Clearly state all terms (price, shipping, delivery time)
- Respond to buyer inquiries within reasonable time
- Ship/deliver within stated timeframes
11.5 Marketplace Fees

11.8 Disputes and Returns
Dispute Process:
- Buyer contacts seller directly
- If unresolved after 48 hours, buyer may open dispute
- FanWork reviews and makes determination
- Decision is final
Return Policy:
- Sellers set their own return policies within platform guidelines
- Minimum: Accept returns for items significantly not as described
- Refund within 14 days of return receipt
11.9 Intellectual Property in Marketplace
- Sellers represent they have rights to sell listed items
- Fan merchandise must comply with fair use principles
- DMCA/takedown requests will be honored
- Repeat IP violations result in seller account termination
11.10 Tax Obligations
Sellers:
- Responsible for collecting and remitting applicable sales tax
- Must comply with local business registration requirements
- FanWork may collect marketplace facilitator tax where required
Buyers:
- May be responsible for import duties on international purchases
- VAT/GST included where applicable
11.11 Marketplace Disclaimers
FanWork is a platform facilitating transactions between buyers and sellers:
- We do not own, manufacture, or inspect items
- We do not guarantee quality, safety, or legality of items
- We are not responsible for seller or buyer conduct
- Disputes are between buyer and seller; we provide mediation only
12\. Prohibited Conduct
12.1 General Prohibitions
You agree NOT to:
- Illegal Activity: Use the Service for any illegal purpose or in violation of any laws
- Harmful Content: Post content that is violent, threatening, abusive, harassing, defamatory, or obscene
- Hate Speech: Engage in discrimination or hate speech based on race, ethnicity, national origin, religion, gender, sexual orientation, disability, or other protected characteristics
- Harassment: Harass, bully, stalk, or intimidate other users
- Impersonation: Impersonate any person or entity, or falsely claim affiliation
- Misinformation: Knowingly spread false or misleading information
- Spam: Send unsolicited communications or post repetitive content
- Privacy Violations: Share others' personal information without consent
- Intellectual Property Infringement: Post content that infringes copyrights, trademarks, or other intellectual property rights
- Security Violations: Attempt to circumvent security features, access unauthorized areas, or interfere with the Service
12.2 Artist-Related Conduct
Given FanWork's focus on fan communities, additional prohibitions include:
- Posting malicious rumors about artists
- Sharing illegally obtained content (sasaeng content)
- Sharing artists' private schedules or locations
- Defaming or attacking artists or their families
- Engaging in fan wars or attacking other fandoms
12.3 Technical Prohibitions
You agree NOT to:
- Use automated means (bots, scrapers) to access the Service without perCollab
- Reverse engineer or decompile any part of the Service
- Introduce malware, viruses, or other harmful code
- Attempt to gain unauthorized access to systems or data
- Interfere with other users' access to the Service
12.4 Consequences
Violations may result in:
- Content removal
- Account warnings
- Temporary suspension
- Permanent ban
- Legal action where appropriate

13\. Intellectual Property
13.1 FanWork's Intellectual Property
The Service, including its design, features, content, and technology, is owned by FanWork and protected by intellectual property laws. You may not copy, modify, or create derivative works without our written perCollab.
13.2 Trademarks
"FanWork," our logo, and related marks are trademarks of Data Town Inc. You may not use our trademarks without prior written consent.
13.3 User-Generated Fan Content
FanWork recognizes the creative nature of fan communities. While we encourage fan creativity:
- Fan content must be clearly labeled as unofficial/fan-made
- Fan content must not be used for commercial purposes without proper rights
- Original creators' credits must be respected
- DMCA and copyright holder requests will be honored
13.4 Copyright Complaints
If you believe your copyrighted work has been infringed, please see our Copyright Policy for the DMCA notice procedure.
14\. Third-Party Services
14.1 Third-Party Links
The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of these third parties.
14.2 Third-Party Integrations
We may offer integrations with third-party services (social media platforms, payment processors). Your use of these integrations is subject to the third parties' terms and privacy policies.
14.3 Social Login
When you authenticate using a social login provider (Google, Apple, Kakao), you authorize us to access certain account information as permitted by that provider and your privacy settings.
15\. Termination and Suspension
15.1 Your Right to Terminate
You may delete your account at any time through account settings, subject to:
- Active Collab participation restrictions (Providers/Collaborators cannot delete during active Collabs)
- 14-day recovery period during which you may restore your account
- 30-day data retention period after which personal data is permanently deleted
15.2 Our Right to Terminate or Suspend
We may suspend or terminate your account if you:
- Violate these Terms or Community Guidelines
- Engage in fraudulent or illegal activity
- Create risk or legal exposure for FanWork
- Repeatedly receive complaints from other users
15.3 Effect of Termination
Upon termination:
- Your right to use the Service immediately ceases
- We may delete your personal data (after the retention period)
- Content you created (Posts, Collabs) may remain, attributed to "DeletedAccount\_\[number\]"
- You remain responsible for any outstanding obligations
15.4 Survival
Sections relating to intellectual property, disclaimers, limitations of liability, indemnification, and dispute resolution survive termination.
16\. Disclaimers
16.1 "As Is" Service
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy or completeness of content
16.2 No Guarantees
WE DO NOT GUARANTEE THAT:
- The Service will be uninterrupted, secure, or error-free
- Results obtained from the Service will be accurate or reliable
- Any errors will be corrected
- The Service will meet your requirements
16.3 User Content Disclaimer
We are not responsible for User Content posted by users. Views expressed in User Content are those of the individual users and do not reflect our views.
16.4 Collab Outcomes
We do not guarantee:
- The success of any Collab
- The quality of Collab participants' contributions
- The fulfillment of Collab commitments by Providers or Collaborators
17\. Limitation of Liability
17.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FANWORK SHALL NOT BE LIABLE FOR:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, or goodwill
- Service interruption or inability to use the Service
- Any conduct or content of third parties on the Service
17.2 Liability Cap
IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE GREATER OF:
- The amount you paid to FanWork in the 12 months preceding the claim, OR
- One hundred US dollars ($100 USD)
17.3 Essential Purpose
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
18\. Indemnification
You agree to defend, indemnify, and hold harmless FanWork, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from:
- Your use of the Service
- Your User Content
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of any applicable laws
19\. Dispute Resolution
19.1 Informal Resolution
Before filing any formal dispute, you agree to first contact us at townhall@fanwork.kr to attempt to resolve the dispute informally for at least 30 days.
19.2 Arbitration Agreement (Where Applicable)
For users in the United States:
You and FanWork agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, rather than in court, except:
- You may assert claims in small claims court if eligible
- Either party may seek injunctive relief in court for intellectual property infringement
The arbitration shall be administered by JAMS under its Streamlined Arbitration Rules. The arbitration will be conducted in English and held in Seoul, South Korea, or via video conference at your election.
CLASS ACTION WAIVER: You and FanWork agree that any arbitration shall be conducted on an individual basis and not on a class, consolidated, or representative basis.
19.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to conflict of law principles.
19.4 Jurisdiction
For matters not subject to arbitration, the courts of Seoul, Republic of Korea shall have exclusive jurisdiction.
19.5 Exceptions for Specific Regions
See Section 23 for country-specific dispute resolution provisions that may override this section.
20\. Changes to Terms
20.1 Right to Modify
We reserve the right to modify these Terms at any time. Material changes will be effective:
- 30 days after posting for existing users
- Immediately for new users
20.2 Notification
We will notify you of material changes through:
- In-app notifications
- Email to your registered address
- Prominent notice on the Service
20.3 Acceptance
